Mich. Counties Can't Appeal BofA Tax Case, 6th Circ. Hears

Law360, New York (January 9, 2014, 5:37 PM EST) -- Bank of America NA on Thursday asked the Sixth Circuit not to revive Michigan counties' allegations that the bank failed to pay taxes on mortgage assignments, saying the appeal had been filed too late.

According to Bank of America's motion, the plaintiffs did not file their appeal in a timely manner, in violation of Rule 59(e) of the Federal Rules of Civil Procedure, which requires that parties file an appeal within 28 days of the judgment.
