Supreme Court Asked To Reject FERC Oversight Preemption

Law360, Houston (January 10, 2014, 8:13 PM EST) -- A group of homeowners told the U.S. Supreme Court on Tuesday they should be allowed to sue over property losses sustained after the Federal Energy Regulatory Commission authorized Entergy Corp. to release water held back by a dam on the Texas-Louisiana border.

In a petition for writ of certiorari, the homeowners urged the high court to overturn a ruling by the Fifth Circuit that property damage claims brought under state law are barred by federal preemption under the Federal Powers Act.
