NY High Court Lets 'Commuter Tax' To Fund MTA Stand

Law360, New York (January 14, 2014, 6:15 PM EST) -- New York’s highest court on Tuesday declined to consider a challenge to a statewide tax that subsidizes New York City’s mass transit system.

Tuesday’s decision leaves in place a June ruling by the Appellate Division of the state Supreme Court, which upheld the tax despite a constitutional challenge brought by several local governments.

The state Legislature in 2009 passed the Metropolitan Commuter Transportation Mobility Tax Law, which it imposed on employers and self-employed people everywhere in New York to provide additional funding for the Metropolitan Transportation...
