5th Circ. Won't Pull Judge Off Deepwater MDL

Law360, Los Angeles (January 16, 2014, 9:52 PM EST) -- The Fifth Circuit has rejected a request by Louisiana's top attorney to pull the federal judge overseeing the BP PLC Deepwater Horizon multidistrict litigation off the state's oil spill damages appeal, according to a court order docketed Wednesday.

In a one-sentence response to Louisiana Attorney General James D. “Buddy” Caldwell's request, the appeals court denied Louisiana's petition for writ of mandamus, which was filed after the state alleged that U.S. District Judge Carl Barbier was violating due process and state sovereignty by holding up the case....
