Calif. Appeals Court Nixes Atty Fees In Debt Collector Suit

Law360, Los Angeles (January 16, 2014, 10:01 PM EST) -- A California appeals court on Thursday reversed a trial court’s decision to award nearly $12,000 in attorneys' fees to a law firm that was accused of improperly collecting debts in a putative class action, finding the borrower who brought the suit had done so in the public interest.

David Tourgeman sued Nelson & Kennard for allegedly listing the wrong lender on collection letters in violation of the Fair Debt Collection Practices Act after the cost of defending his debt topped $38,000, according to the decision. He...
