EEOC Tries To Revive ADA Claims Against Delphi

Law360, New York (March 17, 2008, 12:00 AM EDT) -- The Equal Employment Opportunity Commission has appealed a bankruptcy court order that expunged the federal agency's claim against Delphi Corp. arising from alleged violations of the Americans with Disabilities Act.

The EEOC filed a notice of appeal on Monday of a ruling by the U.S. Bankruptcy Court for the Southern District of New York that disallowed the agency's proof of claim for prepetition relief because it was filed before Delphi's bar date for claims.
