DC Airport Toll Is Not An Illegal Tax, 4th Circ. Says

Law360, New York (January 21, 2014, 6:10 PM EST) -- The Fourth Circuit Tuesday threw out a class action filed by Washington, D.C., taxpayers against the state’s airport regulator, saying the use of vehicle toll funds to pay for the expansion of rail lines to Washington Dulles International Airport does not violate the Virginia Constitution.

In a unanimous opinion, Judge Allyson Kay Duncan said the Virginia Legislature was well within its constitutional rights to delegate toll collecting authority to the Metropolitan Washington Airports Authority, and then use those tolls on transportation projects related to the toll...
