FTC New Year's Resolution: End Deceptive Weight-Loss Ads

Law360, New York (January 31, 2014, 4:57 PM EST) -- The Federal Trade Commission ushered in 2014 with a series of enforcement actions against four weight-loss product purveyors, taking issue with the companies’ advertising tactics, and concurrently issuing updated guidance to media outlets, detailing how to spot potentially misleading advertisements and claims for weight-loss products and services.

In three of these settlements, the FTC made clear that it considers weight-loss claims to be “health claims,” and in all four cases, it emphasized for advertisers the quantity and quality of clinical studies the FTC expects to see in support of weight-loss claims.
