Judge Questions Law In Handing Wyeth Victory

Law360, New York (March 19, 2008, 12:00 AM EDT) -- A judge in Tennessee has ruled in favor of Wyeth in a case involving the withdrawn diet drug known as “fen-phen” but at the same time urged the state legislature to consider revising the product liability statute that led to the ruling.

Judge Curtis Collier of the Eastern District of Tennessee granted Wyeth's motion for summary judgment Wednesday, ruling that a rarely invoked provision of Tennessee's product liability law barred defendant Angela Montgomery from bringing her claim.
