Calif. Justices Asked To Revive Target Coffee Tax Suit

Law360, San Francisco (February 4, 2014, 3:47 PM EST) -- Target Corp. customers on Tuesday urged the California Supreme Court to revive their class action accusing the retailer of fraudulently collecting sales tax on nontaxable takeout coffee, arguing that a state appeals court was wrong to find that it lacked the power to address Target's alleged conduct.

The appellants' attorney told the state high court that Article 13 of the California Constitution doesn't bar consumers from suing retailers who charge a sales tax reimbursement on sales that aren't taxable, such as coffee, as the appeals court...
