NJ Justices To Hear 'Enviro Sensitive' Land Rezoning Row

Law360, New York (February 6, 2014, 5:00 PM EST) -- The New Jersey Supreme Court is poised to decide whether a town went too far by rezoning a property without wetlands, floodplains or other such features as environmental sensitive and reducing the permitted density for development there, according to an order posted Thursday.

The high court has granted certification in Griepenburg v. Township of Ocean and will consider whether the land use designation that required minimum lot sizes of 20 acres for residential development represented an arbitrary and capricious decision on the part of the township,...
