Calif. Agency Decision Dooms 'Organic' Label Suit, Hain Says

Law360, San Francisco (February 6, 2014, 7:13 PM EST) -- The Hain Celestial Group Inc. urged a California federal judge on Thursday to toss a class action accusing it of falsely advertising its cosmetics as predominantly organic, arguing the state Department of Public Health had found the labels didn't violate the California Organic Products Act.

Hain Celestial's attorneys told U.S. District Judge Laurel Beeler that the state health department's finding essentially preempted the consumers' state-law claims and requires the court to grant summary judgment. Although Judge Beeler didn't issue a ruling Thursday, she did cast doubt...
