2nd Circ. Sends Dish Network Fee-Contract Row To Trial

Law360, Los Angeles (February 7, 2014, 6:32 PM EST) -- The Second Circuit on Friday partially overturned a lower court’s judgment on the pleadings in favor of CenturyLink Inc. in its pursuit of fees from Dish Network LLC, finding that the contract’s language was sufficiently ambiguous to take the matter to trial.

In a summary order, the appellate panel ruled that the contract between Dish and CenturyLink could be reasonably interpreted to mean that Dish could stop paying fees to CenturyLink after their deal ended, counter to CenturyLink's claims. The district court had ruled that Dish...
