States Appeal Plan For Regional Power Corridor

Law360 (March 21, 2008, 12:00 AM EDT) -- The commonwealth of Virginia has joined the state of New York in appealing a U.S. Department of Energy decision that could restrict the states' authority over electric power lines.

Virginia Gov. Tim Kaine and Attorney General Bob McDonnell announced on Thursday that they had asked the U.S. Court of Appeals for the Fourth Circuit to overturn the DOE's decision to designate large sections of north and northwestern Virginia as part of a National Interest Electric Transmission Corridor.

McDonnell said the designation could lead to federal preemption...
