Hain Loses 3rd Bid To Ditch Suit Over 'Organic' Labels

Law360, New York (February 11, 2014, 1:53 PM EST) -- A California judge on Monday rebuffed attempts by The Hain Celestial Group Inc. to escape a putative consumer class action challenging "organic" labels on cosmetics, saying a state regulator's probe did not conclusively absolve the company of violating the California Organic Products Act.

U.S. Magistrate Judge Laurel Beeler ruled that the state Department of Public Health's decision not to pursue an enforcement proceeding against Hain did not foreclose the plaintiffs' claims under COPA and for derivative violations of state false advertising laws.
