6th Circ. Nixes Retrial For Man Who Sold Old Parts To Navy

Law360, New York (February 11, 2014, 4:36 PM EST) -- The Sixth Circuit on Tuesday upheld the conviction of a man accused of selling old electronic parts to the U.S. Navy for its nuclear reactors, aircraft and weapons systems, finding his mistrial arguments unconvincing.

A three-judge panel ruled that Jerome Rabinowitz, who was sentenced in 2012 to four years in prison and $850,000 in fines, did not suffer from a mistrial in district court when several jurors saw evidence that had been excluded from the trial since those jurors were removed from the case.
