Ind. Supreme Court Stubs Out City's Smoking Ban

Law360, Washington (February 11, 2014, 6:33 PM EST) -- Indiana’s highest court struck down a city ordinance extending a public smoking ban to bars and restaurants, saying Tuesday that the ordinance's exemption for riverboat casinos violated the state constitution.

In a 3-2 decision, the Indiana Supreme Court reversed a trial court ruling upholding the constitutionality of the 2012 amending ordinance, which was challenged by a group of restaurant and bar owners. An exemption in the Evansville, Ind., ordinance for the city’s only riverboat casino, Casino Aztar, violates the state’s constitution, the opinion said.
