Amazon Hit With Infringement Ruling Over 'Lush' Searches

Law360, New York (February 12, 2014, 3:32 PM EST) -- A U.K. court ruled Monday that Ltd. infringed cosmetics maker Lush Retail Ltd.'s trademarks by showing customers search results from similar, third-party makeup brands after they searched for Lush cosmetics, which aren't sold on Amazon.

The High Court said consumers that saw Amazon's results after typing "Lush" into Amazon's search function would be confused into thinking that the competing cosmetic products were Lush's products. The U.K.-based cosmetic company doesn't allow its makeup to be sold on Amazon for "ethical" reasons.
