9th Circ. UMG Case Changes Music-Licensing Landscape

Law360, New York (February 18, 2014, 1:56 PM EST) -- In Rock River Communications Inc. v. Universal Music Group Inc., the Ninth Circuit took Universal Music Group (UMG) to task for its strategy of using intimidation and threatened litigation to force other companies out of the market. The plaintiff (Rock River) had licensed the right to sample 16 songs recorded by Bob Marley and the Wailers. It purchased the license from San Juan Music Group, which has been openly licensing Marley's recordings for 30 years based on agreements it had with Lee Perry, who produced many of the group's early songs....
