'All Natural' Labels Don't Deceive Consumers, Flax USA Says

Law360, Chicago (February 13, 2014, 1:06 PM EST) -- Flax USA Inc. asked a California federal judge on Wednesday to toss a proposed class action alleging its dairy substitute drinks are falsely labeled as “all natural,” saying a reasonable consumer wouldn’t be misled by the labels.

Plaintiff Garo Madenlian doesn’t even try to identify his — or a reasonable consumer’s — understanding of the phrase “all natural” in his complaint, nor does he back up his contention that the company’s “Flaxmilk” products contain a variety of artificial or processed ingredients, the North Dakota-based company said...
