Court Tosses TSI's Appeal, Citing Jurisdiction

Law360 (March 24, 2008, 12:00 AM EDT) -- The U.S. Court of Appeals for the Seventh Circuit struck a blow to Tooling Systems International on Monday, dismissing the machine maker's allegations of malicious prosecution and fraud against UGS Corp. for actions the software company took to enforce its software licenses in Poland.

The court dismissed the appeal by TSI's owner for lack of standing and appellate jurisdiction and affirmed the lower court's decision that the act-of-state doctrine bars claims for property seized by Polish authorities.
