Ex-Red Robin Worker's Gay Bias Suit Nixed By 2nd Circ.

Law360, Los Angeles (February 13, 2014, 6:08 PM EST) -- The Second Circuit refused Thursday to revive an ex-Red Robin International Inc. employee's suit alleging he was fired for being a homosexual, saying that in light of previous disciplinary actions the plaintiff couldn't prove that the restaurant's firing was a retaliatory act.

Affirming a New York federal judge's decision, a three-judge panel found that the former assistant general manager insufficiently pled his claims that the Red Robin Gourmet Burgers Inc. owner violated Title VII of the Civil Rights Act and a state human-rights law.
