Feds Join FCA Kickback Suit Against Tenet, HMA

Law360, New York (February 20, 2014, 8:25 PM EST) -- The U.S. Department of Justice said Wednesday it’s joining a whistleblower’s False Claims Act suit accusing hospital giants Tenet Healthcare Corp. and Health Management Associates Inc. of paying millions of dollars in kickbacks for referrals of pregnant, Hispanic immigrants whose deliveries were billed to Medicaid.

Tenet and HMA, which was recently purchased by Community Health Systems Inc., allegedly signed sham contracts for interpreter services with clinics that serve Hispanic women, resulting in tens of thousands of fraudulent claims being submitted to Medicaid since 2000.
