First American Beats Privacy Class In Calif. Appeal

Law360, Los Angeles (February 24, 2014, 4:39 PM EST) -- A California appeals court ruled Friday that a putative class of First American Home Buyers Protection Corp. customers alleging their calls were recorded without consent was properly refused certification because they had too many individual questions to resolve.

In a unanimous ruling, a three-judge panel of the California Court of Appeal affirmed Los Angeles Superior Court Judge Charles F. Palmer's denial of class certification in Dina Hataishi's suit against First American, agreeing that Hataishi failed to establish a community of interest among the putative class members....
