Miami Hotel-Water Suit Should Be Covered, 11th Circ. Told

Law360, Miami (February 25, 2014, 7:35 PM EST) -- A mechanical engineering firm, sued when a defective water system it designed for a downtown Miami hotel resulted in its temporary closure, told the Eleventh Circuit on Tuesday that a district court erred in ruling the firm's insurer had no obligation to defend it.

Hufsey-Nicolaides-Garcia-Suarez Associates Inc. claims that James River Insurance Co. falsely invoked an exclusion in its professional liability policy, mischaracterizing the incident at the Epic Hotel and Residences in Miami as arising from the presence of Legionella bacteria in the water.
