Calif. Appeals Court Won't Certify Class In PacBell Wage Row

Law360, Los Angeles (February 27, 2014, 4:15 PM EST) -- A California appeals court on Wednesday refused to grant class certification in an action brought by two sales executives accusing Pacific Bell Telephone Co. of not reimbursing them for mileage expenses, ruling the class didn't meet the predominancy requirement needed for certification.

Affirming a lower court's order denying certification, the appeals judges found variations in the travel patterns of sales executives — including whether they reported to their home offices — leading to individualized questions over their commute deductions.
