Sprint Patent Case Stayed For AIA Review, With Conditions

Law360, New York (March 4, 2014, 6:23 PM EST) -- A California federal judge on Friday agreed to stay a patent case against Sprint Nextel Corp. pending the outcome of inter partes reviews of the patents sought by other companies, provided Sprint doesn't pursue the same invalidity theories used in the reviews if the patents survive.

Sprint has not asked the U.S. Patent and Trademark Office to review Evolutionary Intelligence LLC's data processing patents under the America Invents Act, so it would not ordinarily be barred from relitigating the same invalidity theories later in the case....
