Sutter Health Rips Monopoly Suit's Geographic Market Theory

Law360, San Francisco (March 6, 2014, 5:20 PM EST) -- Sutter Health urged a California federal judge on Thursday to throw out a proposed class action accusing the health network of conspiring to monopolize medical services in Northern California, arguing that the plaintiffs' evidence outlining the geographic market Sutter supposedly controls is implausible.

The plaintiffs' effort to define eight “hospital services areas” on the basis of ZIP codes alone ignores the fact that in many of those areas, residents have a number of other hospital options, argued Sutter's attorney, Jeffrey LeVee with Jones Day.
