Justices Decline Circuit City Class Arbitration Appeal

Law360, New York (March 31, 2008, 12:00 AM EDT) -- The U.S. Supreme Court declined Monday to hear Circuit City Stores Inc.'s appeal of a decision allowing its employees to arbitrate a wage-and-hour claim against the company as a class despite an arbitration agreement in their contracts that bars class claims.

The decision let stand a ruling handed down in August by the California Supreme Court, which had overturned the California Court of Appeal's ruling against former Circuit City Stores Inc. employees who sought to bring class allegations against their old employer. All the employees' contracts...
