11th Circ. Says Insurer Owes Coverage In Hotel-Water Row

Law360, New York (March 10, 2014, 6:33 PM EDT) -- The Eleventh Circuit said Monday that a district court erred in ruling that James River Insurance Co. has no duty to indemnify a mechanical engineering firm against claims that its negligence contributed to a cruise ship passenger contracting Legionnaires' disease.

The three-judge appellate panel found that some claims against Hufsey-Nicolaides-Garcia-Suarez Associates Inc. do not arise from the presence of Legionella bacteria in the Epic Hotel and Residences’ water system, ruling James River therefore has at least some duty to defend.
