Landlord Can't Revive $5M Claim For Blocked Renovations

Law360, Los Angeles (March 11, 2014, 6:21 PM EDT) -- A New York appeals court on Tuesday affirmed a lower court's ruling that a landlord cannot recover $4.7 million from a tenant that wouldn't let the landlord make renovations, saying delay damages can't be sought when a tenant fails to make repairs to a property.

In an 3-2 ruling, a five-judge panel of the New York Supreme Court's Appellate Division wrote that a state court was right to dismiss counterclaims brought by 101 Limited Partnership — a partnership of Andalex Group and Edward J. Minskoff Equities...
