Sleepy's Drivers Take Misclassification Fight To NJ High Court

Law360, New York (March 17, 2014, 9:03 PM EDT) -- Attorneys for a putative class of delivery drivers who contend that Sleepy's LLC wrongfully treated them as independent contractors urged the New Jersey Supreme Court on Monday to adopt a test for such classifications that would place the burden of proof on employers.

Anthony L. Marchetti, an attorney for the drivers, said the so-called ABC test used by the New Jersey Department of Labor and Workforce Development was the best way to determine employment status under the state's Wage Payment Law and Wage and Hour Law....
