Owens Corning, Fidelity ERISA Suit Survives

Law360, New York (April 2, 2008, 12:00 AM EDT) -- A federal judge has refused to dismiss a putative ERISA class action against Owens Corning’s retirement savings plan and plan fiduciary Fidelity Management Trust Co., ruling that the defendants’ claims did not warrant dismissal at this phase in the case.
