Texas Slams EEOC Over 'Felon-Hiring Rule'

Law360, New York (March 19, 2014, 2:34 PM EDT) -- The state of Texas fired back Tuesday at the U.S. Equal Employment Opportunity Commission's effort to nix the state's lawsuit challenging the agency's guidance on using criminal background checks in hiring, saying the EEOC wants “to have their cake and eat it too.”

The agency lodged a motion to dismiss the state's Texas federal court lawsuit in January, asserting that the court lacks jurisdiction to review the guidance and that the timing of the litigation presented insurmountable problems for the state's case.
