Ga. High Court Limits Duty To Indemnify For Lloyd's Insurer

Law360, New York (March 19, 2014, 2:55 PM EDT) -- The Georgia Supreme Court concluded Monday that a Lloyd's insurer did not have to indemnify Agco Corp. for underlying defective product claims until a court held that the agricultural machinery manufacturer was liable for those claims, reversing prior rulings in the case.

While the trial court and intermediate appeals court had sided with Agco, the Georgia high court had a different take on when a master insurance policy required Lloyd's syndicate Cassidy Davis to indemnify customers' claims that RoGator, a self-propelled agricultural spray applicator, was defective....
