Fla. High Court Tweaks Jury Instructions In Med Mal Cases

Law360, New York (March 20, 2014, 6:41 PM EDT) -- The Florida Supreme Court signed off Thursday on an amendment to the state's standard jury instructions specifying that a defendant who caused an injury is responsible for any additional injury caused by reasonably obtained medical care or treatment.

The state’s high court gave its approval to append a paragraph, titled “subsequent injuries caused by medical treatment,” to Section 501.5 of the Florida’s standard jury instructions, which pertains to other contributing causes of damage under compensatory personal injury and property damages.
