Old Navy Escapes Sales Ban On Infringing 'Active' Products

Law360, New York (March 24, 2014, 3:43 PM EDT) -- A California federal judge on Friday refused to prevent Old Navy LLC from selling products that a jury has found infringe trademarks held by Active Sports Lifestyle USA LLC, ruling the plaintiffs hadn't shown that Old Navy's sales would cause them irreparable harm.

Ruling that Active Sports hadn't proven it would be irreparably harmed by Old Navy's continued sales of athletic wear bearing the phrase "Active by Old Navy," U.S. District Judge James V. Selna declined to impose a permanent injunction on the infringing clothing line.
