Fed. Circ. HUD Case Holds Agencies To Contracting Process

Law360, New York (March 25, 2014, 9:04 PM EDT) -- The Federal Circuit on Tuesday blocked the Department of Housing and Urban Development from using grants, not contracts, to administer its public housing projects, a ruling that will restrict agencies' efforts to avoid the bid protests and formal competitions that are part and parcel of federal contracting.

Contractors had sued HUD for allegedly seeking to evade competition requirements in its administration of subsidized housing in 42 jurisdictions, and the legal fight created a split between the Government Accountability Office and Court of Federal Claims on the...
