Microsoft Dodges Phone-Tracking Class Action

Law360, New York (March 25, 2014, 6:38 PM EDT) -- A Washington federal court on Tuesday tossed out a pending class action against Microsoft Corp. that accused the company of illegally tracking customers via their smartphones.

The court found that Microsoft was not in violation of the Stored Communications Act just because a Windows Mobile 7 camera application gathered location information from plaintiff Rebecca Cousineau's phone. Cousineau had not allowed the app to gather her location data but she did have her phone's master location switch on, which let other apps gather the same data....
