Class Certified In FLSA Suit V. Phone Insurer

Law360, New York (April 14, 2008, 12:00 AM EDT) -- A Tennessee federal judge has granted conditional class certification to workers at two Tennessee call centers for mobile phone insurer Asurion Corp. but refused to recognize a class of Houston workers as part of the wage-and-hour collective action.

U.S. District Judge Robert L. Echols of the Middle District of Tennessee ruled Thursday that plaintiffs had made a “modest showing” that nonexempt hourly-pay workers at two Nashville centers were not paid for time preparing for or finishing work as mandated by the Fair Labor Standards Act....
