Court Sides With Insurers In Hurricane Katrina Action

Law360, New York (April 15, 2008, 12:00 AM EDT) -- A federal appeals court has dealt a blow to Louisiana residents in their fight against major U.S. insurers over claims in the wake of Hurricane Katrina, affirming the removal of their state class action to the less-friendly federal jurisdiction.

A year after upholding the dismissal of a similar case brought by policyholders, the U.S. Court of Appeals for the Fifth Circuit has again sided with the insurance companies, ruling the class action suitable for adjudication by the U.S. District Court for the Eastern District of Louisiana....
