Workers Say Hershey Jobs Aren't So Sweet

Law360, New York (April 15, 2008, 12:00 AM EDT) -- Several former sales representatives of The Hershey Company have filed a proposed class action alleging they were misclassified and improperly deprived of overtime pay.

The lawsuit, filed April 7 in the U.S. District Court for the Northern District of California, said that since Hershey realigned its sales force in 2003 staff members are “glorified merchandisers.” But since they are classified as sales workers, they are not eligible for overtime compensation under California and federal law.
