Teva Shoots Back With Suit Against Pfizer

Law360, New York (February 17, 2006, 12:00 AM EST) -- Israeli generics maker Teva Pharmaceutical Industries Ltd. fired off a lawsuit Friday in an attempt to counter claims that it had violated patent laws regarding the production of a popular antibiotic called azithromycin—a generic version of the Pfizer Inc.-developed drug Zithromax.

Teva’s suit, filed in the U.S. Southern District Court of New York, seeks to reject claims that its drug azithromycin, and materials related to it, infringed on Pfizer’s patent.

More specifically, the suit seeks a declaratory judgement of non-infringement and patent invalidity.
