Restaurant Chain Looks To Block Wage-and-Hour Suit

Law360, New York (April 23, 2008, 12:00 AM EDT) -- Bankrupt restaurant chain Buffets Holdings Inc. has filed an adversary case in an effort to put a halt to a wage-and-hour suit brought against the company’s executives after Buffets entered Chapter 11.

In a complaint filed Tuesday, Buffets asked the U.S. Bankruptcy Court for the District of Delaware for a declaration that the putative class action filed in California state court violates the automatic stay that protects the bankrupt company.
