Constellation Hit With FLSA Suit

Law360, New York (April 24, 2008, 12:00 AM EDT) -- A Constellation Energy Group Inc. unit has been hit with a potential collective action for allegedly misclassifying its business development associates as exempt from overtime.

In a complaint filed Monday with the U.S. District Court for the Southern District of Texas, business development associate Arati Shah alleges that she worked more than 40 hours per week but was paid a straight salary, in violation of the Fair Labor Standards Act.

“Shah was paid the same salary regardless of the number of hours worked,” the complaint said....
