Iowa High Court Says Residents' Pollution Row Not Preempted

Law360, New York (June 13, 2014, 3:48 PM EDT) -- The Iowa Supreme Court on Friday revived a class action alleging a corn-based products manufacturer is negligently releasing harmful chemicals onto residents’ homes and properties, finding that the residents’ state-law claims are not preempted by the federal Clean Air Act.

In a unanimous opinion, the appeals court reversed the lower court’s ruling that the eight residents can sue Grain Processing Corp. on behalf of other Muscatine, Iowa, residents, saying Friday that their claims are not preempted by federal law or Iowa's statutory companion to the CAA...
