GSK Wants 3rd Circ. To Toss RICO Claims In Avandia MDL

Law360, New York (July 1, 2014, 4:03 PM EDT) -- GlaxoSmithKline LLC on Monday asked the Third Circuit to toss racketeering claims in three class actions accusing the drugmaker of hiding heart disease risks associated with the diabetes drug Avandia, arguing the plaintiffs haven’t alleged a clearly identifiable injury.

In October, Pennsylvania U.S. District Judge Cynthia M. Rufe refused to dismiss claims made by three union benefit funds under the Racketeer Influenced and Corrupt Organizations Act, ruling the plaintiffs had adequately alleged a scheme whereby GSK suppressed evidence of Avandia’s cardiovascular risks to increase the number...
