Suit Claims DreamWorks Stole Idea For 'Madagascar'

Law360, New York (May 14, 2008, 12:00 AM EDT) -- A Florida man who claims that DreamWorks Animation SKG Inc. stole his idea for the 2005 animated film “Madagascar” has sued the studio, seeking all the profits from the film.

Joseph Davis filed his suit Tuesday in the U.S. District Court for the Southern District of Florida, accusing DreamWorks of copyright infringement, constructive fraud, unjust enrichment and breach of implied contract.

Davis claims that plot, characters and visual style of “Madagascar” closely resemble those of a children's book he wrote, “Animal's Night Out.” The film starred...
