Judge Nixes Abbott's Patent Defense In Norvir Case

Law360, New York (May 20, 2008, 12:00 AM EDT) -- A judge knocked out a major part of Abbott Laboratories' defense against an antitrust suit related to its HIV treatment Norvir, ruling Friday that claims in two of Abbott's patents for a method of combining Norvir with other protease inhibitors are invalid.

Judge Claudia Wilken of the U.S. District Court for the Northern District of California also ruled that plaintiffs in the suit cannot seek damages under state common law but could seek injunctive relief under federal antitrust law. She also said that California plaintiffs could...
