FCC Says Decision Is Near On Sirius-XM Merger

Law360, New York (May 27, 2008, 12:00 AM EDT) -- The U.S. Federal Communications Commission could rule by the end of June on the controversial merger between XM Satellite Radio Holdings Inc. and Sirius Satellite Radio Inc., FCC Chairman Kevin Martin has confirmed.

“The commission could act by the end of the second quarter,” Martin told reporters Thursday. The deal was first announced 17 months ago.

Martin did not discuss why the FCC has taken so long to consider the deal. The U.S. Department of Justice approved XM-Sirius on March 24, saying that the merged company...
